Outrun Solution LLC (“Outrun Solution”, “us”, or “we”) provides cloud-based storage solutions for employers in the trucking and transportation industry (the “Customer(s)”). Documents and information may be uploaded to Outrun Solution’s online portal or mobile application (individually and collectively, the “Platform”) by a Customer or directly from a Customer’s employees, independent contractors, or applicants (individually and collectively, the “Employees”). Customers and Employees are all contemplated to be users of the Platform and may be interchangeably and collectively referred to as “you” when applicable.
This Privacy Notice describes the Personal Data (defined below) we collect from Customers, Employees, and visitors to the Platform, and how Outrun Solution uses, maintains, protects, and discloses Personal Data you provide to Outrun Solution or which we collect through your use of our Platform. Please read this Privacy Notice carefully so that you can make informed decisions about sharing Personal Data with us.

Outrun Solution will disclose or share the Personal Data, or relevant portions thereof, to the Customer to fulfill or meet the reason for which the information was provided. More simply, the Customer has hired Outrun Solution to provide cloud-based storage of documents and information which contains Personal Data, and the Customer will be granted access to the Personal Data of its Employees that is maintained in our storage.
Outrun Solution’s cloud-based storage is hosted through Google Cloud Platform. As such, Personal Data will also be disclosed or shared to Google Cloud Platform.
Personal Data may also be used by Outrun Solution internally or disclosed to third-parties for technical support and to diagnose technical issues, to improve the Platform, to respond to law enforcement requests, or as otherwise required by applicable law, court order or governmental regulations.
Personal Data may be transmitted, stored, and processed by Outrun Solution in the United States and elsewhere in the world to fulfill our business purposes and the purposes which we outlined in this Privacy Notice. By providing us with your Personal Data or otherwise engaging with use through our Platform, you acknowledge that Personal Data stored or processed in the United States will be subject to the laws of the United States, including the ability of governments, courts, law enforcement and regulatory agencies of the United States to obtain access to your Personal Data in some circumstances.
We cannot guarantee the safety and privacy of Personal Data that an Employee or Customer provides to any third parties through the use of our Platform or otherwise. Any Personal Data collected by third parties is not covered by this Privacy Notice, and we are not responsible for the practices and policies of such third parties, including other websites, services or applications. All users should review the policies of such third parties and contact them directly to respond to your questions.
The security of your Personal Data is important to Outrun Solution. We have implemented appropriate technical and organizational security measures designed to protect the security of any Personal Data we collect and process, both during transmission and once we receive it. The Personal Data of each Customer is isolated from the Personal Data of other Customers. Of course, the security of your Personal Data also depends on Employees and Customers as users of the Platform; where you have credentials for access to certain parts of the Platform, you are responsible for keeping such credentials confidential. We cannot guarantee the absolute security of data that is electronically stored or transmitted over the internet, and there is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If we learn of a security breach, we may notify you or others consistent with applicable data breach notification law.
A Customer’s Personal Data will be retained 5 years after the Customer has canceled its services with Outrun Solutions, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). A Customer may demand in writing that all of the Customer’s Personal Data is removed at an earlier date and we will comply to the extent permitted by law. Upon the expiration of 5 years or such date requested by the Customer (if applicable), we will either delete or anonymize your Personal Data. If this is not possible (for example, because your Personal Data is stored in back-up archives), we will securely store your Personal Data and isolate it from any further processing until deletion is possible.
You, an Employee, have the right to request that Outrun Solution disclose certain information to you about our collection and use of your Personal Data over the 12 months prior to your request. Once we receive your request and verify it, we will disclose to you:
Upon reviewing our report of the information listed above, you have the right to ask us to rectify inaccurate Personal Data, delete Personal Data, and/or withdraw your consent so that we can no longer collect your Personal Data (to the extent your consent is required to collect it).
Deletion is subject to certain exceptions which would allow Outrun Solution to deny the request for deletion. The most common reason we would deny a deletion request would be that the Personal Data is necessary for us to provide business services to the Customer, and such Personal Data is required to be maintained by the Customer (i.e. your employer or potential employer), to fulfill compliance requirements from the Department of Transportation or other laws and regulations. To make a request for disclosure of your Personal Data or a request, rectify and/or delete Personal Data, or to withdraw your consent of our processing of your Personal Data, please e-mail this request to helpdesk@outrunsolution.com. To verify the request, you must provide sufficient information that allows us to confirm you are the person about whom we have collected Personal Data, or an authorized representative of said individual. Your request should include sufficient other details about your specific request so we can evaluate and respond to it.
Outrun Solution endeavors to respond to a verifiable consumer request within 45 days of receipt of your e-mail. If we require additional time (up to 90 days), we will inform you of the reason and extension period in writing. All communication relating to your request, including the response, will be e-mailed back to the requesting e-mail address unless otherwise directed.
Outrun Solutions does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Outrun Solution will not discriminate against you for exercising your rights as detailed in this Privacy Notice. Unless permitted by applicable law, we will not deny or diminish your use of the Platform or other services provided by Outrun Solution.
